Overview: 

Since the HITECH Act of 2009 medical providers have been required to create their records in electronic form.  This presentation discusses the HITECH requirements; the various commercial platforms available and their pluses and minuses; how the use of EMR’s has changed the operation of rules of evidence; and the compromises and procedures used when EMR’s are obtained from clients, disclosed in discovery, and used as exhibits at deposition and at trial.
